TERMS OF SERVICE

These Terms govern your access to and use of Not Real Live, including the website, desktop app, hosted checkout pages, cloud proxy, account system, and related services.

By downloading, installing, accessing, creating an account, starting a subscription, buying top-up credits, or using the app or services, you agree to these Terms. If you do not agree, do not download, install, access, purchase, or use Not Real Live.

If a signup, checkout, update, or app screen asks you to confirm these Terms, that confirmation is an additional acceptance of the same Terms.

Not Real Live is software for generating simulated stream chat. It can connect to OBS, analyze selected stream visuals and audio, and generate AI chat messages that appear in the app's chat interface.

The product does not provide real viewers, real Twitch engagement, real Twitch chat activity, followers, subscribers, or platform growth. It is a simulation and testing tool.

You are responsible for keeping your account credentials secure and for activity under your account.

You must provide accurate account and billing information. You may not share, sell, or transfer your account except with our written permission.

Paid plans are billed through Paddle, our merchant of record. Paddle may collect payment details, calculate taxes, send receipts, handle payment support, and apply Paddle buyer terms and policies.

Subscriptions renew automatically until canceled. You can cancel from inside the app. Unless required by law or Paddle's buyer policies, cancellation takes effect at the end of the current billing period and does not create a partial-period refund.

Plans include monthly credits. Top-up credits are one-time purchases. Credits are used to operate AI features and may be consumed by model calls, transcription, vision analysis, search, or related processing.

Prices, credit amounts, features, and models may change. If a change materially affects an active paid plan, we will try to provide reasonable notice.

You may use Not Real Live for practice streams, testing overlays, demos, entertainment, and private workflow experiments.

You must not use Not Real Live to deceive viewers, sponsors, platforms, advertisers, or business partners into believing AI-generated chat is real human activity.

You must not use the product for unlawful, harmful, abusive, harassing, defamatory, infringing, deceptive, spam, malware, scraping, credential theft, platform-manipulation, or sexually exploitative activity.

You must not use the product with child sexual abuse material, child sexual exploitation, grooming, sexual content involving minors, non-consensual sexual content, illegal pornography, sexual extortion, or content that attempts to create, normalize, solicit, or discuss abuse of children or vulnerable people.

You must not use the product to generate or process content involving credible threats, terrorism or violent extremism, instructions for serious wrongdoing, hate or harassment, privacy invasion, doxxing, impersonation, fraud, or other material that violates our providers' safety policies.

You must not bypass billing, rate limits, access controls, model restrictions, security features, or attempt to overload or interfere with the service.

You must not attempt to obtain free usage, free credits, free tokens, unauthorized discounts, unauthorized refunds, or other unpaid access by exploiting bugs, manipulating requests, sharing credentials, creating duplicate accounts, tampering with usage metering, chargeback abuse, or any other workaround.

You must not share accounts, resell, sublicense, redistribute, reverse engineer, decompile, or create competing services from Not Real Live except where applicable law allows despite this restriction.

We may monitor usage, request metadata, provider safety responses, billing behavior, and abuse signals to protect the product, users, providers, and the public.

If an AI provider, payment provider, infrastructure provider, automated safety system, or manual review flags a request, account, stream, prompt, image, audio clip, transcript, payment, or usage pattern as abusive, unsafe, fraudulent, or otherwise suspicious, we may immediately suspend or terminate the account while we investigate.

For serious violations, including child exploitation, illegal sexual content, fraud, attempts to bypass billing or usage limits, account sharing, attacks on the service, or repeated safety-policy violations, we may immediately and permanently ban the account, revoke access, cancel subscriptions, remove or expire unused credits or top-up balances, and block future purchases.

To the maximum extent allowed by law and Paddle's buyer policies, users banned for abuse, fraud, illegal content, or serious Terms violations are not entitled to refunds, credits, chargeback assistance, compensation, or restoration of unused balances.

We may preserve evidence, cooperate with service providers, report suspected illegal activity to law enforcement or child-safety organizations, and disclose information when we believe it is necessary to protect people, comply with law, enforce these Terms, or protect the service.

We are not required to provide advance notice before taking enforcement action where doing so could create legal, safety, security, fraud, or abuse risk.

You are responsible for the stream content, audio, screenshots, prompts, game titles, and other inputs you provide or make available to the app.

You grant us permission to process those inputs through our app, cloud proxy, and service providers solely to provide, secure, debug, and improve Not Real Live.

You must have the rights and permissions needed to process any content you send through the app, including consent where your audio or stream includes other people.

AI-generated messages can be inaccurate, repetitive, inappropriate, offensive, insulting, vulgar, harmful, unsafe, unlawful, or unsuitable for public use. Output may include unexpected statements, aggressive language, encouragement of risky behavior, references to illegal activity, or other material you may find objectionable.

AI output is generated automatically from model providers and user/app inputs. It does not represent our views, advice, instructions, endorsement, or intent, and you should not rely on it as factual, legal, safety, medical, financial, or professional guidance.

You are responsible for reviewing, moderating, stopping, deleting, hiding, or otherwise controlling how generated output is used, displayed, streamed, repeated, or acted on. You are also responsible for any decision you make, action you take, or content you publish based on AI output.

To the maximum extent allowed by law, we are not responsible for offense, distress, reputational harm, platform consequences, account consequences, audience reactions, losses, damages, or other harm arising from AI-generated output or your use of it.

We do not guarantee that generated messages will be safe, accurate, platform-compliant, or appropriate for every audience.

The product depends on third-party services such as Supabase, Paddle, Vercel, Google Cloud, OpenAI, Anthropic, Google, Groq, Sentry if configured, OBS, and your operating system or browser.

Third-party services may have their own terms, policies, outages, pricing, limits, and data practices. We are not responsible for third-party services we do not control.

Not Real Live may be updated automatically or manually. Updates may add, change, or remove features.

The product may include beta, experimental, or preview features. Those features may break, change, or be discontinued.

We may suspend or terminate access if you violate these Terms, create security or legal risk, misuse the service, fail to pay, or use the product in a way that could harm the service, our providers, or others.

You may stop using the product at any time. Canceling a subscription stops future renewals but does not automatically delete account or billing records.

Not Real Live is provided as is and as available. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and that AI output will meet your expectations.

You use Not Real Live and any AI-generated output at your own risk. We do not control every model response and cannot guarantee that provider filters, safety systems, prompts, settings, or moderation controls will prevent all offensive, harmful, unsafe, unlawful, or unwanted output.

You are responsible for complying with Twitch, OBS, payment, platform, advertising, disclosure, consumer protection, and other rules that apply to your use.

To the maximum extent allowed by law, Not Real Live will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; loss of goodwill; business interruption; or platform/account consequences.

To the maximum extent allowed by law, our total liability for claims relating to the service is limited to the amount you paid for Not Real Live during the three months before the event giving rise to the claim.

We may update these Terms as the product changes. The updated version will be posted on this page with a new effective date. Continued use after the update means you accept the updated Terms.
